    These Terms of Service ("Terms") govern your access to and use of the Vettedmark platform at vettedmark.au. By creating an account or using any part of the service, you agree to be bound by these Terms.

    1. The Service

    Vettedmark is a Digital Compliance Passport platform. It enables Australian suppliers and contractors to build a verified compliance profile, upload compliance documentation for review, and share a compliance link with procurement teams and facilities managers.

    Compliance monitoring features, including automated document expiry alerts, are paid-tier features that are being released progressively and are not all in operation yet.

    Vettedmark is compliance verification infrastructure. It is not a compliance advisory service, insurance broker, legal advisor, or employment agency.

    2. Eligibility

    To use Vettedmark, you must:

    Hold a valid Australian Business Number (ABN).

    Be authorised to represent the business entity associated with that ABN.

    Be at least 18 years of age.

    3. Account Responsibilities

    You are responsible for:

    Maintaining the security of your account credentials.

    Ensuring all information you provide is accurate, current, and complete.

    Uploading genuine compliance documentation.

    Updating documents before they expire.

    Vettedmark accepts no liability for any incorrect, misleading, or outdated information submitted by you.

    4. Compliance Status

    Your compliance status on Vettedmark is determined algorithmically from the state of the documents you upload. Individual documents are assessed before they are approved or rejected, and in the current phase that assessment is carried out by the Vettedmark compliance team. Your overall compliance status is then computed from those document records by fixed rules. Vettedmark does not manually set, adjust, or guarantee your overall compliance status.

    Verification is point-in-time. A "verified" status confirms that, at the time of computation, the required documents were current and approved. It does not constitute an endorsement of your business's operational performance, financial solvency, safety record, or quality of work.

    No manual overrides. No Vettedmark staff member can set or override the compliance status your documents produce. If your documents do not meet the platform's verification rules, your status will reflect that.

    Automatic expiry. Compliance status is calculated against document expiry dates. An expired document produces a not-verified status when your status is next computed. There are no grace periods and no discretionary extensions.

    5. Acceptable Use

    You agree not to:

    Upload falsified, altered, or fraudulent documentation.

    Misrepresent your business identity, ABN, or credentials.

    Attempt to access another user's account or data.

    Interfere with, disrupt, or circumvent the platform's security or verification systems.

    Use the platform for any unlawful purpose.

    Vettedmark reserves the right to suspend or terminate any account that violates these Terms.

    6. Intellectual Property

    All content, design, code, and branding on vettedmark.au is owned by Vettedmark Pty Ltd. You may not reproduce, distribute, or create derivative works from any part of the platform without written permission.

    Your uploaded documents remain your property. By uploading documents to Vettedmark, you grant us a limited licence to store, process, and display them solely for the purpose of operating the verification service.

    7. Authorisation to Verify

    By using Vettedmark, you authorise us to verify the status of your credentials with relevant issuing bodies, including but not limited to insurance providers, regulatory authorities, licensing bodies, and government registers such as the Australian Business Register and state fair trading and licensing registers.

    8. Registry Visibility

    Your profile is private by default. Your business will only appear in the Vettedmark Supplier Registry if all of the following conditions are met:

    Your profile status is "claimed".

    Your compliance status is "verified".

    You may control who receives your shareable Digital Compliance Passport link. Vettedmark does not share your profile publicly without your knowledge.

    9. Right to Remove

    Vettedmark reserves the right to remove, suspend, or restrict any profile or account that is found to contain inaccurate, misleading, or fraudulent information, or that no longer complies with our verification standards.

    10. Pilot Program Terms

    If you are participating in the Vettedmark Pilot Program:

    The service is provided free of charge for the duration of the pilot period.

    The service is provided "as is" and "as available" without warranty of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

    Vettedmark does not guarantee uninterrupted access, error-free operation, or the accuracy of verification results during the pilot.

    Vettedmark accepts no liability for any decisions made by you, your clients, or any third party in reliance on compliance status displayed on the platform during the pilot.

    Features, functionality, and data formats may change during the pilot without notice.

    Pilot participation does not guarantee access to the platform after the pilot concludes, though participants will receive a Founding Member offer.

    11. Limitation of Liability

    To the maximum extent permitted by Australian law:

    Vettedmark is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service.

    Vettedmark is not liable for any loss, damage, or claim arising from reliance on compliance status displayed on the platform, including but not limited to decisions to engage, contract with, or continue engagement with any supplier.

    Vettedmark's total aggregate liability to you for any claim arising from these Terms or your use of the service shall not exceed the total fees paid by you in the twelve (12) months preceding the claim.

    Compliance status on Vettedmark is informational. It is not a guarantee, warranty, or certification of any kind. Procurement teams and buyers remain responsible for their own due diligence.

    12. Indemnification

    You agree to indemnify and hold harmless Vettedmark Pty Ltd, its directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from your use of the service, your violation of these Terms, or any inaccurate information you provide.

    13. Termination

    You may close your account at any time by contacting verify@vettedmark.au. Vettedmark may suspend or terminate your account if you breach these Terms, with or without notice.

    On termination, your profile will be removed from the registry and your personal information will be handled in accordance with our Privacy Policy.

    14. Governing Law

    These Terms are governed by the laws of the Australian Capital Territory, Australia. Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the courts of the Australian Capital Territory.

    15. Changes to These Terms

    We may update these Terms from time to time. Material changes will be communicated via email to registered users and posted on this page with an updated effective date. Continued use of the platform after changes are posted constitutes acceptance of the revised Terms.
